Please read these Terms of Service carefully before using demographics.fyi. These terms govern your access to and use of the platform, including any content, functionality, and services offered on or through the site.
Section 1
Acceptance of Terms
By accessing or using demographics.fyi (the “Platform”), you agree to be bound by these Terms of Service (the “Terms”). These Terms constitute a legally binding agreement between you and demographics.fyi.
If you do not agree to these Terms, you must not access or use the Platform. Your continued use of the Platform following any changes to these Terms constitutes your acceptance of those changes.
Section 2
Description of Service
demographics.fyi provides aggregated workplace demographics data for technology companies. The Platform collects, processes, and presents data sourced from anonymous user submissions and publicly available EEO-1 filings.
The Platform is provided for informational purposes only. Company scores, rankings, and demographic breakdowns are derived from available data and are intended to provide general insight into workplace composition trends across the technology industry.
demographics.fyi does not provide legal, employment, or career advice. The data presented on the Platform should not be used as the sole basis for any employment or business decisions.
Section 3
User Accounts
Account creation on demographics.fyi is optional. You may create an account to track your submissions and access additional features. When creating an account, you agree to the following:
- You must be at least 18 years of age to create an account on the Platform.
- You are responsible for maintaining the confidentiality and security of your account credentials. You agree to notify demographics.fyi immediately of any unauthorized use of your account.
- You are responsible for all activity that occurs under your account, whether or not you have authorized such activity.
- demographics.fyi reserves the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
Section 4
Submissions and Content
Users may submit anonymous workplace demographics data to the Platform (“Submissions”). By making a Submission, you represent and agree to the following:
Requirements
- All Submissions must be truthful and based on your personal, firsthand experience at the company in question.
- You must have been or currently be employed at, contracted with, or otherwise directly affiliated with the company about which you are submitting data.
Prohibited Submissions
- Fabricated, falsified, or intentionally misleading data.
- Submissions about companies at which you have never worked or been affiliated.
- Coordinated campaigns to artificially inflate or deflate a company’s scores.
- Inclusion of personally identifiable information (PII) about other individuals, including but not limited to names, contact information, or any data that could be used to identify a specific person.
Rights and Moderation
- demographics.fyi reserves the right to review, reject, remove, or modify any Submission at its sole discretion, with or without notice, for any reason including but not limited to suspected inaccuracy or violation of these Terms.
- By making a Submission, you grant demographics.fyi a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, aggregate, and display the anonymized data contained in your Submission for the purposes of operating and improving the Platform.
Section 5
Acceptable Use
When using the Platform, you agree not to engage in any of the following prohibited activities:
- Unauthorized Data Collection. Scraping, harvesting, or collecting data from the Platform in bulk without express written permission from demographics.fyi.
- De-anonymization. Attempting to identify, de-anonymize, or trace any Submission back to an individual submitter, whether through technical means, cross-referencing, or any other method.
- Harassment. Using any data or information obtained from the Platform to harass, threaten, intimidate, or target any individual or group of individuals.
- Discriminatory Use. Using the Platform or its data for discriminatory purposes, including but not limited to using data to discriminate against individuals on the basis of race, gender, ethnicity, age, disability, sexual orientation, or any other protected characteristic.
- Platform Interference. Interfering with, disrupting, or attempting to gain unauthorized access to the Platform’s servers, networks, or infrastructure, or engaging in any activity that imposes an unreasonable load on the Platform’s systems.
Violation of these restrictions may result in immediate termination of your access to the Platform and may subject you to legal liability.
Section 6
Data Accuracy Disclaimer
demographics.fyi strives to present accurate and meaningful data. However, you acknowledge and agree to the following:
- Company scores, rankings, and demographic breakdowns are based on the data currently available to the Platform and may not reflect a complete or fully accurate picture of any company’s workplace demographics.
- Data presented on the Platform is crowdsourced and self-reported. While we employ measures to detect and filter inaccurate submissions, we cannot guarantee the accuracy, completeness, or reliability of any data point.
- demographics.fyi is not responsible for any decisions made by individuals, companies, or other entities based on data obtained from the Platform, including but not limited to employment decisions, investment decisions, or public statements.
- The Platform is not a substitute for direct employer research, including reviewing official company disclosures, conducting interviews, or consulting professional advisors.
Section 7
Intellectual Property
The following intellectual property terms apply to your use of the Platform:
- The Platform’s design, source code, visual identity, branding, and all original content are the exclusive property of demographics.fyi and are protected by applicable copyright, trademark, and other intellectual property laws.
- Aggregated data, company scores, and rankings generated by the Platform may be referenced, cited, or shared publicly, provided that clear and visible attribution to demographics.fyi is included.
- Company names, logos, trademarks, and other identifying marks displayed on the Platform are the property of their respective owners. Their appearance on the Platform does not imply endorsement, sponsorship, or affiliation with demographics.fyi.
Section 8
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- The Platform is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- demographics.fyi, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform or any data obtained from the Platform.
- In no event shall the total aggregate liability of demographics.fyi exceed the amount you have paid to demographics.fyi for use of the Platform. For users of the free tier, this amount is zero dollars ($0.00).
Section 9
Indemnification
You agree to indemnify, defend, and hold harmless demographics.fyi, its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Platform or any data obtained from the Platform.
- Any Submission you make to the Platform.
- Your violation of these Terms.
- Your violation of any rights of any third party, including intellectual property rights or privacy rights.
This indemnification obligation shall survive the termination of these Terms and your use of the Platform.
Section 10
Termination
Either party may terminate this agreement as follows:
- By demographics.fyi: We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the Platform will immediately cease.
- By You: You may delete your account at any time through the Platform’s account settings. Deletion of your account will remove your profile information. However, anonymized Submissions that have already been incorporated into aggregated data sets will be retained.
Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification, and limitation of liability.
Section 11
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall be resolved through binding arbitration administered by a recognized arbitration body in the State of California. The arbitration shall be conducted in English, and the arbitrator’s decision shall be final and binding on both parties.
You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against demographics.fyi.
Section 12
Changes to Terms
demographics.fyi reserves the right to modify, amend, or replace these Terms at any time at its sole discretion. When material changes are made, we will update the “Last Updated” date at the top of this page and, where practicable, provide notice through the Platform.
Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of and agreement to the updated Terms. If you do not agree with the revised Terms, you must discontinue your use of the Platform.
We encourage you to review these Terms periodically to stay informed of any changes.
